There are more than 500 state recycling laws already on the books, but as budgets tighten, state lawmakers are looking at manufacturers to help fund politically popular recycling programs -- and to create new ones. There is also serious concern over toxics in the waste stream, and the current decline in package recycling rates. In the last two years, the number of bills we track has increased by one-third!

Here are some of the issues we're covering this year:

  • Massachusetts and California are moving on bills to require takeback on cathode ray tube items, . . four states now ban CRTs from landfills . . .meanwhile, industry is at the table trying to negotiate a new national takeback plan for electronics, likely to cost billions – and include new federal legislation! There were about 52 bills introduced in 26 state hoppers in 2003 -- we expect more in 2004 becuase national talks are faltering.
  • Ontario Canada HAS APPROVED a new regulation that requires companies to weigh and pay fees on their sales packaging and paper inserts, by Aptil 20 of 2004 under Bill 90. Implementation of this law has industry fighting mad, as estimates of costs doubled to $85 million (CDN) by 2005. This is a complex but critical issue -- SRLU is the only newsletter covering this issue in detail.
  • Hawaii recently enacted the first bottle deposit law in 16 years. State are strapped for cash this year and several are looking to keep unclaimed deposits or expand current deposit laws. There were about 61 deposit bills introduced in 2003. . .
  • California continues to enforce its recycled content law on rigid plastic containers, this year with audits (125 companies already have had to sign compliance orders) – plus state staff is looking at new policy options. Californians Against Waste plans to push new packaging legislation soon. .
  • Rhode Island has passed a sweeping ban on mercury products, while Maine and Vermont have mercury labeling requirements, and Connecticut and Washington have enacted bans as well. At least ten states have banned mercury thermometers, and there were 65 bills in the hoppers that will impact medical equipment, certain pharmaceuticals, and mercury-containing electronics in 2003.

  • Plus we are covering a host of bills impacting used oil, oil filters, tires, and auto recovery, as well as commercial waste, C&D, composting, and newsprint mandates.
  • Flow Control New York and Toronto are off-loading their trash on Virginia and Michigan. The battles will continue.
